§1. General provisions

1. These Terms set out the rules for using Milo Hotel App, referred to as the "Panel" or "Milo Hotel".

2. Milo Hotel is intended for pet hotels, pet sitters and other entities professionally or commercially organising animal care.

3. The Service Provider is:

operating under the brand "Milo App", referred to as "Milo" or the "Service Provider".

4. Milo Hotel is a service separate from Milo App for animal owners.

5. Milo is not a party to the agreement between the Hotel and its client and does not provide animal care.

6. Milo Hotel is solely an organisational tool. It is not a veterinary practice or clinic, does not provide veterinary services, does not diagnose animals, and is not an emergency system or a guaranteed alarm system.

§2. Definitions and roles

1. Hotel – an entrepreneur, pet sitter or other entity using the Panel in connection with providing care services.

2. Hotel Client – an owner or caregiver entrusting an animal to the Hotel.

3. Manual Profile – a client or animal profile created by the Hotel based on data obtained directly from the client.

4. Linked Profile – animal data shared with the Hotel by a Milo App Owner user.

5. Active Profile – an animal profile remaining in the active part of the Hotel's account and counted towards the plan limit.

6. Milo Hotel Standard – a free plan allowing work on a maximum of ten Active Profiles.

7. Milo Hotel Premium – a paid plan intended for a Hotel needing higher limits or additional features.

8. Price List – information on plans, limits, prices and scope of features, available in the Panel or in Milo's offer.

9. Hotel Content – client data, animal data, agreements, documents, notes, schedules and settlements entered by the Hotel.

§3. Manual and linked profiles

1. The Hotel may work:

  • a) on Linked Profiles shared by Milo App Owner users;
  • b) on Manual Profiles created independently.

2. The Hotel may add a client and an animal even if the client does not have a Milo App Owner account.

3. For a Manual Profile, the Hotel:

  • a) obtains the data itself;
  • b) determines the legal basis for processing it;
  • c) is responsible for the correctness of the data;
  • d) fulfils its own information obligations;
  • e) determines the retention period.

4. Creating a Manual Profile does not automatically create a Milo App Owner account.

5. The Panel may allow sending the client a later invitation to Milo App Owner.

6. In a Linked Profile, the scope of data depends on the information saved and shared by the owner.

7. The owner may restrict or revoke access to a Linked Profile.

§4. Technical requirements

1. Using the Panel requires a device with internet access, an up-to-date browser, JavaScript enabled, an active e-mail address, and appropriate device settings.

2. Notifications require a compatible device and system permissions.

3. The Hotel should protect the devices and login data used to access the Panel.

4. The Hotel is responsible for its own internet connection and for organising its use of the Panel.

§5. Hotel account

1. The agreement to use the free Panel is concluded when the account is created and the Terms are accepted.

2. The person creating the account represents that they are authorised to act on behalf of the Hotel.

3. The Hotel is responsible for the truthfulness and currency of the account data.

4. The Hotel must protect its login data and must not share the account with unauthorised persons.

5. The Hotel is responsible for actions performed using its account to the extent permitted by law.

§6. Features of the Panel

1. Depending on the plan, the Panel may allow:

  • a) manually adding clients and animals;
  • b) handling Linked Profiles;
  • c) maintaining a calendar of stays, check-ins and check-outs;
  • d) recording location and stay information;
  • e) maintaining task lists;
  • f) feeding and medication schedules;
  • g) marking activities as completed;
  • h) storing agreements and documents;
  • i) recording information on deposits and payments;
  • j) maintaining a cooperation history;
  • k) sending invitations to Milo App Owner;
  • l) receiving notifications.

2. The Panel is not an accounting, tax, legal or veterinary system.

3. Payment data is of a record-keeping nature and does not replace bank confirmations or accounting documents.

4. Milo does not verify the content of the Hotel's agreements and does not guarantee their legal validity.

§7. Milo Hotel Standard and the profile limit

1. Milo Hotel Standard is free and allows work on a maximum of ten Active Profiles.

2. The rules for marking a profile as active or archived are indicated in the Panel.

3. Once the limit is reached, the Panel may block the addition of further Active Profiles until:

  • a) unused profiles are archived;
  • b) data the Hotel should no longer retain is deleted;
  • c) Milo Hotel Premium is activated.

4. Reaching the limit does not automatically delete existing data.

5. Milo may in the future change the limit for new periods of use, informing about it in accordance with the rules on amending the Terms. The change does not apply retroactively to an already paid scope of Premium.

§8. Three-month welcome period

1. A new Hotel account receives a one-time, three-month access to Milo Hotel Premium, unless more favourable terms were indicated before registration.

2. The welcome period:

  • a) is free of charge;
  • b) does not require providing a payment card;
  • c) does not result in an automatic charge;
  • d) does not create an obligation to purchase Premium;
  • e) is available once per Hotel.

3. After the welcome period ends, the account automatically switches to Milo Hotel Standard, unless the Hotel enters into a paid Premium agreement.

4. Data is not deleted solely because the welcome period has ended, but Standard limits may begin to apply.

5. Milo may refuse a repeat trial in the event of a new account being created by the same entity or an attempt to circumvent the promotion's rules.

§9. Milo Hotel Premium

1. Milo Hotel Premium is offered on the basis of the current Price List or an individual quote.

2. Purchase takes place outside the Panel, through an inquiry, an offer, or an order and invoice.

3. Unless the offer states otherwise, Premium is granted for 12 months.

4. The offer specifies:

  • a) the net and gross price;
  • b) the currency;
  • c) the access period;
  • d) the scope of features and limits;
  • e) the payment deadline;
  • f) the moment of activation;
  • g) the rules for termination or extension.

5. Milo Hotel Premium is not currently paid automatically via Stripe.

6. Premium does not renew automatically, unless an individual agreement expressly provides otherwise.

7. After Premium ends, the account switches to Standard, unless the parties agree on an extension.

8. Failure to pay on time may result in delayed activation, suspension of Premium, or a switch to Standard after an appropriate notice.

9. In the event of a conflict between the Terms and an individually accepted offer regarding the price, period or scope of Premium, the offer prevails.

§10. Hotel client data

1. The rules for Milo's processing of the Hotel's account data are set out in the Privacy Policy.

2. With respect to client data entered by the Hotel, the Hotel generally determines independently the purposes and legal bases for their processing.

3. The Hotel undertakes to:

  • a) obtain data lawfully;
  • b) fulfil information obligations;
  • c) enter only necessary data;
  • d) not retain it longer than justified;
  • e) ensure that only authorised persons have access to this data;
  • f) respond to requests from data subjects.

4. Where Milo processes data on behalf of the Hotel, this relationship is governed by data processing agreement terms.

5. Acceptance of Milo's Terms by the animal's owner does not replace the Hotel's obligations towards its client.

§11. Linked Profiles

1. Data from a Linked Profile may be used only in connection with care, stay, the animal's safety, communication, and legitimate settlements.

2. The Hotel may not use data obtained solely from a Linked Profile for unrelated marketing or the sale of data.

3. This prohibition does not prevent the Hotel from maintaining its own database of persons with whom it has its own contractual relationship.

4. Revoking access may limit the visibility of a Linked Profile.

5. Revoking access does not require the deletion of data that the Hotel is obliged or entitled to retain under law, its own agreement, or the need to defend claims.

§12. Agreements and documents

1. Milo provides the technical ability to store or display documents.

2. Milo is not a party to the Hotel's agreement with the client, does not check its validity, and does not confirm signatures.

3. The Hotel is responsible for the documents' compliance with the law.

4. The Hotel should keep its own copies of documents of legal, accounting or evidentiary significance.

5. The Panel is not a qualified archive or a qualified signature service.

§13. No veterinary services

1. Milo Hotel does not replace a veterinarian, an examination of the animal, or documentation kept by a veterinary practice.

2. The Panel does not clinically analyse the animal's condition and cannot assess whether it requires treatment.

3. Health-related content is general and educational in nature.

4. The Hotel is responsible for actual care and emergency procedures.

5. In an emergency, the Hotel should be guided by the animal's safety, the law, a current veterinarian's recommendation, and arrangements with the owner.

6. A current veterinarian's recommendation takes precedence over information recorded in the Panel.

7. In case of conflicting data, the Hotel should not guess but should contact the owner or a veterinarian, unless immediate action is necessary.

8. Milo is not liable for the quality of the Hotel's care services or for health decisions made by the Hotel, the client or the veterinarian.

§14. Medication

1. The medication schedule is based on data entered by users.

2. Milo does not check the medication name, dose, interactions, contraindications, currency of the prescription, or actual administration.

3. Before administering medication, the Hotel should check:

  • a) the animal;
  • b) the preparation;
  • c) the dose;
  • d) the method and time of administration;
  • e) the last recorded status;
  • f) the current veterinarian's recommendation;
  • g) the owner's instructions.

4. A status such as "given", "done" or similar is a declaration by the user, not an independent medical confirmation.

5. Marking a status does not release the Hotel from the duty of actually performing the activity.

6. The Hotel should have an independent procedure to prevent double dosing, missed doses, animal mix-ups, and simultaneous performance of an activity by several people.

7. The Panel should not be the only mechanism for controlling medication administration.

8. Milo is not liable for the consequences of incorrect data, an incorrect status, a missed or double administration, subject to liability that cannot be excluded by law.

§15. Notifications

1. Notifications about medication, feeding, stays, check-ins and check-outs are solely an auxiliary feature.

2. Milo Hotel is not a dispatch, emergency or guaranteed alarm system.

3. Delivery of a notification depends on the device, system, browser, internet connection, permissions, battery settings, external services, and synchronisation.

4. A notification may not be delivered, may arrive late, may be duplicated, hidden, or may contain outdated data.

5. The absence of an alert does not release the Hotel from the duty to maintain the schedule and provide actual care.

6. The Hotel should apply its own procedures and task lists.

7. For medication and critical activities, the Panel may not be the sole means of control.

8. The Hotel should check tasks directly in the Panel regardless of notifications.

9. Milo is not liable for the consequences of the absence, delay, duplication or incorrect notification, where the cause remains beyond Milo's control or results from the device, settings, external services, incorrect data, or the Hotel's lack of its own procedure, subject to liability that cannot be excluded by law.

§16. Deposits and client payments

1. These features serve solely the Hotel's internal record-keeping.

2. Milo is not a party to the settlements between the Hotel and the client.

3. A payment status is not a bank confirmation of a transaction.

4. The Hotel should verify payments in the appropriate financial system.

5. Milo does not keep the Hotel's accounts and is not liable for its taxes or sales documents.

§17. Prohibited use

The following is prohibited, in particular:

  • a) entering unlawful content;
  • b) processing data without a legal basis;
  • c) infringing clients' rights;
  • d) circumventing plan limits;
  • e) unauthorised access;
  • f) mass copying of data without authorisation;
  • g) transmitting malicious software;
  • h) reselling access without Milo's consent;
  • i) using data from Linked Profiles beyond the scope of care.

§18. Availability and data copies

1. Milo exercises due care to ensure the Panel functions correctly, but does not guarantee uninterrupted availability.

2. The Hotel should not treat the Panel as the sole place for storing agreements, accounting documents, medication instructions, and emergency procedures.

3. The Hotel should keep its own copies of important documents.

4. Interruptions may result from updates, failures, attacks, external services, or force majeure.

§19. Liability

1. Milo is liable for its own service on the terms provided by law.

2. The Terms do not exclude liability that cannot be excluded, in particular for intentional acts.

3. To the extent permitted by law, Milo is not liable for:

  • a) the quality of the Hotel's care;
  • b) actions of the Hotel, the client, and the veterinarian;
  • c) the content of the Hotel's agreements;
  • d) the correctness of data entered by the Hotel;
  • e) the Hotel's compliance with industry, tax and consumer requirements;
  • f) the loss of unsecured data;
  • g) sharing login data with an unauthorised person;
  • h) a decision based solely on an unverified status or notification;
  • i) external services beyond Milo's control.

4. In a B2B relationship, Milo's liability for lost profits is excluded to the extent permitted by law.

§20. Complaints

1. Complaints may be submitted to hello@miloapp.pet.

2. A complaint should, where possible, include the Hotel's name, the account address, a description of the problem, the date, and the device.

3. Milo handles a complaint within 14 days of its receipt.

§21. Deletion or suspension of the account

1. The Hotel may end use of the free Panel by deleting the account or contacting Milo at hello@miloapp.pet.

2. The terms for ending Premium arise from the offer or agreement.

3. Before deleting the account, the Hotel should download necessary documents and secure data required by law.

4. Milo may suspend an account in the event of a serious breach of the Terms, a security threat, unlawful data processing, an attempted fraud, a payment arrears, or a legal obligation.

5. Data after the cooperation ends is processed in accordance with the Privacy Policy and the data processing agreement terms.

§22. Changes

1. Milo may amend the Panel or the Terms due to changes in law, technology, features, providers, plans, or security rules.

2. Changes are not retroactive.

3. The Hotel will be informed of material changes by e-mail or via the Panel.

4. A change does not deprive the Hotel of an already paid scope of Premium contrary to an accepted offer, unless required by law or security considerations.

§23. Final provisions

1. Polish law applies to the Terms.

2. Matters not regulated herein are governed by the laws of Poland and the European Union.

3. The invalidity of a single provision does not render the remaining provisions invalid.
